Terms of Service

A licence to use, not ownership
These terms govern your use of Embroidery & Sewing ("we", "us", "our") and every design you buy from us. By creating an account, placing an order, or otherwise using the shop, you agree to them. If you do not agree, please do not use the service.

When you buy a design you are buying a LICENCE to use the digital file — you are not buying the design itself or any intellectual-property rights in it. The copyright and all other rights in every design remain ours (or our licensors’) at all times.
What each licence allows
Your rights depend on the tier you choose at checkout. In summary: Personal covers gifts and items you keep; Commercial (small business) lets you sell unlimited finished items you stitch yourself, short of mass or industrial production, and never permits sharing, reselling or redistributing the design file; Extended covers high-volume production and multi-line selling. The Licence Guide sets out the full detail for each tier and always governs what your specific purchase allows.
A licence is granted to the buyer named on the order, for that buyer’s use only. It cannot be transferred, shared, sold, lent or assigned to anyone else, and it does not pass to a third party if you sell or transfer your business unless we agree in writing.
What you may never do
- Resell, redistribute, give away, swap, rent or sub-licence the digital design files themselves, in any format, whether free or paid.
- Share, upload, sync or store the files in any public, shared or file-sharing location, or pass them to anyone outside your licence.
- Mass-produce or sell the design as a digital product, pattern or font (you sell the stitched item, never the file).
- Use a design in any unlawful, infringing, defamatory or otherwise objectionable way, or in a manner that implies we endorse you.
- Remove, obscure or alter any notice of ownership embedded in or supplied with a file, or reverse-engineer a file to recreate or distribute the underlying design.
Pricing, payment and delivery
Prices are shown in the currency displayed at checkout and may change at any time before you order; the price you confirm at checkout is the price that applies to that order. You are responsible for any taxes or duties that apply where you live.
Payment is taken through our third-party payment provider. We do not see or store your full card details — that is handled by the provider. Submitting an order is an offer to buy, which we accept when we make your files available.
Our designs are delivered to you immediately as digital downloads. Once an order is complete the files are made available in your account library and by email, and it is your responsibility to download and keep safe copies of your files.
Your account and conduct
You must give accurate account details and keep your login credentials confidential. You are responsible for all activity under your account. Tell us promptly if you suspect any unauthorised use.
We may suspend, restrict or close an account, and may revoke any licence obtained in breach, where an account breaches these terms, infringes our rights, attempts to defraud us, or abuses the service or other users.
No warranty and limit of liability
Designs and the service are supplied "as is" and "as available", without warranties of any kind except those that cannot lawfully be excluded. Stitch-out results depend on your machine, stabiliser, thread, hooping and fabric, which are outside our control.
To the fullest extent permitted by law, our total liability arising from or in connection with any design, order or your use of the service is limited to the amount you paid for the order in question, and we are not liable for any indirect, incidental or consequential loss, or for loss of profit, data or goodwill. Nothing in these terms excludes liability that cannot lawfully be excluded.
Your responsibility to us
You agree to cover us for any claim, loss or cost (including reasonable legal fees) arising from your breach of these terms, your misuse of a design or the service, or your infringement of anyone else’s rights.
Changes to these terms
We may update these terms from time to time — for example to reflect new features or legal requirements. The current version always lives on this page with the date it last changed. Continuing to use the service after a change means you accept the updated terms.
General
These terms, together with the Licence Guide, Privacy Policy and Refund Policy, are the entire agreement between us about the service. If any part is found unenforceable, the rest continues to apply. Our not enforcing a right is not a waiver of it. You may not assign these terms; we may assign them to a successor of our business.
Governing law
These terms are governed by the laws of the State of Qatar, and the courts of the State of Qatar have exclusive jurisdiction over any dispute, without prejudice to any consumer-protection rights you cannot lawfully be deprived of in your country of residence.
